These terms of use (the "Terms") govern your use of the Ooples application (the "App"). By downloading and using the App, you accept these Terms without reservation.
1. Purpose of the Service
Ooples is an iOS private messaging app that allows two people to exchange messages, photos, voice recordings and documents in a secure, encrypted space. The service is intended for use between two identified and paired users.
2. Access to the Service
Using the App requires: a compatible iPhone running a sufficiently recent version of iOS; an active internet connection for real-time messaging; and pairing with a second iOS device belonging to the person you wish to communicate with.
The App is available for free on the App Store. Specific conditions may apply if the business model changes, and you will be informed in advance.
3. Acceptable Use
By using Ooples, you agree to: use the App in compliance with applicable laws and regulations; not use the App for unlawful, fraudulent or harmful purposes; not attempt to circumvent the App's security mechanisms; not use the App to harass, threaten or harm another person; and not transmit content that violates applicable laws.
4. User Obligations
You are solely responsible for the content you share via the App. Ooples does not control or moderate content exchanged between users, as this content is end-to-end encrypted and inaccessible to Ooples.
You are responsible for the security of your device and access credentials. You agree to report any unauthorised use of the App to our support team.
5. Security and Encryption
Ooples implements end-to-end encryption for all messages and files exchanged. This mechanism ensures that only you and your partner can access the content of your conversations. However, you are responsible for the physical security of your device.
6. Service Availability
Ooples endeavours to ensure continuous availability of the App. However, interruptions may occur for maintenance, updates or unforeseen events. Ooples shall not be liable for temporary service interruptions. Ooples reserves the right to modify, suspend or discontinue all or part of the service with reasonable notice where circumstances allow.
7. Limitation of Liability
To the extent permitted by applicable law, Ooples shall not be liable for: content exchanged between users; data loss resulting from technical failure, device change or intentional deletion; indirect damages resulting from use or inability to use the App; or actions or omissions of third parties.
8. Intellectual Property
The App, its code, interface, trademarks, logos and all its elements are the exclusive property of the publisher and are protected by intellectual property laws. Any unauthorised reproduction, modification, distribution or exploitation is strictly prohibited. Content you share via the App remains your property. Ooples claims no rights over that content.
9. Suspension and Termination
Ooples reserves the right to suspend or terminate a user's access to the service in the event of a violation of these Terms, including abusive, fraudulent or illegal use of the App. You may at any time stop using the App and delete your data from the app settings.
10. Governing Law
These Terms are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution before any judicial proceedings.
11. Changes to the Terms
Ooples reserves the right to modify these Terms at any time. For material changes, you will be notified via the App. Continued use of the App after notification constitutes acceptance of the updated Terms.
